The reference for a preliminary ruling was made in the course of proceedings between (i) the Centre hospitaller universitaire (University Hospital), Besancon ('Besancon CHU') and (ii) Mr Dutrueux and the Caisse primaire d'assurance maladie dujura (primary sickness insurance fund of the Department of the Jura) concerning compensation for burns caused to Mr Dutrueux by a heated mattress in the course of an operation.
