The disposal of discharge lamps is controlled by the Environmental Protection Act, 1990 and the Duty of Care Regulations and the Special Waste Regulations Act, 1996. Monitoring and enforcement is carried out by the Environment Agency in England and Wales, in Scotland by the Scottish Environmental Protection Agency and in Northern Ireland by the Northern Ireland Environment and Heritage Service. Due to the small quantities of toxic elements in each lamp, discharge lamps are not classified as special waste under the Special Waste Regulations. However, the resultant waste products formed as a consequence of chemical reactions that can take place during the crushing process, may be classified as special waste and need to be treated accordingly.
