The New York Supreme Court's Appellate Division decided to affirm the lower court's granting of a summary judgment in favor of the defendant condominium complex association in a suit brought by a unit owner alleging conversion when the association decided to move her boat slip three feet. The court said the association established a prima facie case for the application of the business judgment rule by showing its actions were authorized by the bylaws, and that the minutes of the association's meetings provided a clear record of the decision.
