An enduring feature of research into companies which violate environmental regulations is a discussion of whether punishment can deter them from further violating the law. Despite decades of study, the ability of punishment - usually fines - to deter is inconclusive. However, such discussions have somewhat put the cart before the horse because, although it is clear that some companies violate regulations, we lack information about what predicts the re-occurrence of such behaviour.
