China's State Administration for Industry and Commerce has issued an order which uses for the first time, the Anti-Monopoly Law to pursue cases against companies abusing their intellectual properly rights, mainly patents, to fend off competition. Analysts warn however, that overzealous enforcement could threaten multinational companies and have a negative impact on innovation. SAIC Order No. 74 "Provisions on Prohibition of Abuse of Intellectual Property Rights to Eliminate or Restrict Competition" dated April 7, takes effect on August 1. It aims "to promote competition and innovation, and improve economic efficiency, safeguarding the interests of consumers and the public interest".
