Appellate court judges are suggesting the Army Corps of Engineers may lack discretion when deciding whether to respond to comments on the impacts of its Clean Water Act (CWA) permit decisions, even in cases where the government does not believe commenters are proposing options for limiting "significant" harms to wetlands and other water resources. During oral argument Sept. 22 in Sierra Club, et al. v. Robert Van Antwerp, et al, in the U.S. Court of Appeals for the District of Columbia Circuit, two of the three judges on the appellate panel said the government should have responded to comments from environmentalists who were seeking to scale back a permit the Corps was proposing to issue to a developer wanting to build a shopping center on wetlands and other sensitive land.
