In Pending Suit, Industry Claims EPA 'Misrepresented' Water Blending Ban

An industry group is claiming that EPA's vetoes of a series of municipal Clean Water Act (CWA) permits is proof EPAhas "misrepresented" its response to a 2013 ruling saying it cannot bar "blending" of partially and fully treated wastewater in wet weather events, in an attempt to boost the group's suit to force nationwide implementation of the ruling. In a March 18 brief filed with the U.S. Court of Appeals for the District of Columbia Circuit, the petitioners in Center for Regulatory Reasonableness (CRR) v. EPA argue that contrary to the agency's earlier claims that it is still weighing options, EPA has already decided not to enforce the blending decision outside the jurisdiction of the court that issued it, as shown by an Oct. 9 memo from EPA Region 2 to New Jersey municipalities saying that blending is generally prohibited.
