International Commercial Law

This Survey covers the international community's efforts in 2008 to modernize and harmonize international commercial law. A major development in 2008 was the U.N. General Assembly's adoption of the Convention on Contracts for the International Carriage of Goods Wholly or Partly by Sea-the "Rotterdam Rules."rnThe United Nations Commission on International Trade Law ("UNCITRAL" or the "Commission"), the Organization of American States ("OAS"), the Hague Conference on Private International Law (the "Hague Conference"), and the International Institute for the Unification of Private Law ("UNIDROIT") lead efforts to update international commercial law. UNCITRAL acts primarily through its six working groups, which generally meet biannually. We discuss the efforts made in 2008 by each of these international bodies.
