The most recurrent question in 2008's Article 8 cases involved the extent to which Article 8 displaces common law and equitable claims. Most of the cases opted for displacement, in a variety of contexts.rnArticle 8 requires an issuer to register a transfer if the person requesting the registration fulfills specified conditions. If the conditions are met, the issuer is liable to the person for any unreasonable delay in or failure to register the transfer.2 But if the issuer registers a transfer that it should not have-for example, to a person not entitled to the security pursuant to an ineffective indorsement or instruction-then the issuer is liable for wrongful registration of transfer.
