While the subprime mortgage crisis took center stage in 2008, privacy continued to be a hallmark issue. The states led the charge, enacting new privacy laws and refining and amending the privacy laws already in place. The U.S. Congress again introduced privacy legislation, demonstrating a continued commitment to the issue. However, as of the time of this writing, no new federal privacy legislation had been enacted. The Federal Trade Commission ("FTC") remains at the forefront on privacy matters and was very active addressing privacy concerns in advertising and marketing, areas that are garnering increased attention. This Survey explores developments affecting privacy in the areas of marketing and advertising, in addition to reviewing the developments followed in recent years, such as security breach notice, security freezes, Social Security number protection, disposal of personal information, and data safeguarding.
