The internet has grown at a remarkable pace during the past decade. Fueled by the widespread availability of wireless networks, e-mail has evolved as an increas-ingly transitory form of communication. Wireless connectivity means that e-mails, and other written messages, can be transmitted and received from a seemingly limitless number of sources. Technological enhancements continue to reinvent the manner and means in which attorneys communicate with their clients. In the context of electronic discovery, the existence of metadata presents a double-edged sword. An insightful reflection on the expectation of privacy was provided in a 1998 essay by Lawrence Lessig.
