Survey of Computer Fraud and Abuse Act Cases

The application and interpretation of the CFAA continue to evolve, as new courts weigh in on key issues and as new situations present themselves. The existence and communication of company policies that define acceptable uses of business computer systems and use of company information can play an important role in CFAA cases. However, until there is more uniformity and consistency in its application and interpretation, the weight of such policies in a CFAA claim may vary depending on the jurisdiction. We anticipate the upcoming survey year to be filled with continued controversy over the parameters of the CFAA.
