Rotterdam-based law firm AKD says a recent decision of the Dutch courts means that shipyards in the Netherlands may no longer be able to rely on the rightto retain a vessel while awaiting paymentfor work done. The dispute before the Gelderland Court involved two tankers being built at Markerink yard in the Netherlands. Rijndec Quality Control (RQC) intended to transfer ownership of the completed vessels to two separate affiliated companies, RijndecTrading (RT) and Rijndec Shipping (RS).The contracts with the yard were signed by RT and RS, not by RQC, and ING Bank held mortgages on both vessels.
