EPA Attempts to Breathe New Life into the PAL Provisions of Its 2002 NSR Reform Rules

Acting on what it termed a broad-based, bipartisan call for improving NSR, EPA first introduced what would come to be known as its “2002 NSR Reform Rules” in June 2002. Touting the increased energy efficiency and emissions reductions to follow, the reform rules were finalized on December 31, 2002, and were aimed at simplifying the federal major NSR permitting process (applicable to new or modified “major”sources with a potential to emit a regulated pollutant at a rate greater than or equal to 250 tons per year, or 100 tons per year for “List of 28” sources).
