SAFETY FITNESS DETERMINATIONS: WHAT IS FMCSA MEASURING?

The following article by Mark J. Andrews is based on included comments presented in 2017 to the Federal Motor Carrier Safety Administration (FMCSA) concerning the efficacy of the Agency's Safety Measurement System (SMS) for motor carriers, including the modifications to that methodology suggested by the National Academies of Sciences (NAS). Subsequently, FMCSA has responded to NAS by issuing its proposed Corrective Action Plan in June 2018. The NAS did not address the detailed requirements of the FAST Act (Public Law 114-94, section 5122) that it examine SMS methodology, instead offering the recommendation: "The FMCSA should undertake a study to better understand the statistical operating statistics of the percentile ranks to support decisions regarding the usability of public scores."
