Comment. Legal challenges to aviation policy has a long lineage, see, for example, the last two rounds of Heathrow challenges: R. (on the application of Wandsworth LBC) v Secretary of State for Transport [2005] EWHC 20 (Admin); [2006] 1 E.G.L.R. 91 and R. (on the application of Hillingdon LBC) v Secretary of State for Transport [2010] EWHC 626 (Admin); [2010] J.P.L. 976. On 25 October 2016, the Secretary of State for Transport announced that the north-west runway scheme at Heathrow was the Government's preferred option for delivering additional runway capacity in south east England and that this would be included in a draft national policy statement. To try to keep that process on track the Minister appointed Sir Jeremy Sullivan (who had ruled part of the White Paper unlawful in the Wandsworth case) to oversee the consultation.
