Copyright infringement and the second generation of social media:why pinterest users should be protected from copyright infringement by the fair use defense

The fair use defense should alleviate many of Pinterest users' copyright liability concerns. Although Pinterest contains a vast array of republished images-and this article could not possibly analyze the liability of every different type of pin-most of the republish-ing on Pinterest should be protected by the statutory fair use defense. This offers significant, but not absolute, protection to Pinterest users. This conclusion is not just significant to Pinterest-it can be extrapolated to other free, image-based social media websites.
