PHMSA Issues HM-233F Proposed Rulemaking to Incorporate Almost 100 Special Permits into the Hazardous Materials Regulations

On January 30, 2015, the Pipeline and Hazardous Materials Safety Administration (PHMSA) published a notice of proposed rulemaking (NPRM) in the Federal Register (80 FR 5340) proposing to amend the Hazardous Materials Regulations (HMR) to incorporate provisions contained in 98 existing special permits (SPs) into the HMR. The proposal would eliminate the need for these SPs and the associated burdens on SP holders and make the provisions of the SPs more widely available. Selection of these 98 SPs was based on an extensive analysis, by PHMSA and DOT modal administrations, of all active SPs (1,168 SPs) to determine which may be suitable for conversion into regulations of general applicability.
