In granting the extension sought, the court said the rider was wholly inappropriate. Clearly, Motorola had ample time to prepare their defences and any future judge wouold take that into account when considering any further extension. The whole issue had been a disproportionate waste of money and of the court s time, contrary to the overriding objective of r1.1(2) of the Civil Procedure Rules.
