The U.S. Supreme Court decided in Jesinoski v. Countrywide Home Loans, Inc., 2015 WL 144681 (U.S. 2015), that a mortgage borrower exercising his or her right to rescind a mortgage transaction is only required to provide written notice of that intent to the mortgage lender during the three-year period after executing the mortgage, under the federal Truth in Lending Act, 15 U.S.C.A. §§ 1635(a),(f) ("TILA"). The Act does not require the mortgagor to file a lawsuit within the three years in order to exercise that right.
