Former Fannie Mae Official Properly Sentenced As 'Public Official' for Wire Fraud Undermining Public Trust in Agency's Affordable Housing Program Where She Sold Real Estate Listings to Brokers Below Market Value for Bribes and Kickbacks
The Ninth Circuit upheld the convictions and sentencing of a former Fannie Mae official for honest-services wire fraud based on her using her Fannie Mae position to sell real estate listings to certain select real estate brokers at below market-value prices in exchange for bribes and kickbacks. The appellate court said that the district court properly instructed the jury that the official met the broad definition of a "public official" under the Sentencing Guidelines as a person in a position of public trust with an official responsibility to carry out a government affordable housing program.
