Creamer v. Arbella Insurance Group, - N.E.3d -, 95 Mass.App.Ct. 56, 2019 WL 1142756, No. 18-P-330 (Mass. App. Apr. 7, 2014) was a decision by the Massachusetts of Appeals that the homeowners insurer of the seller of residential property could be held liable under the policy for a judgment by the purchasers against the sellers for costs incurred as a result of an oil spill on the property which the sellers affirmatively misrepresented to the buyers, as the insurer's defense that the misrepresentations were an intervening cause under the policy failed.
