The district court granted only partial summary judgment to Nu-West because the court decision only resolves specific issues relating to CERCLA liability. The court did not consider any damage issues or any CERCLA Section 107 defenses. Therefore, the decision "is narrow in scope and has no precedential value for the next phase of litigation beyond its finding that the government is an owner, operator, and arranger . . ." with regard to the CERCLA cleanup costs associated with the four mine sites and sought by Nu-West.
