摘要

This recent decision of the First TierTribunal (Information Rights) required the disclosure under the Environmental Information Regulations 2004 of information about financial guarantee arrangements in relation to landfill permits. Although the tribunal's reliance on the Derry case is arguably flawed, the tribunal adhered closely to the classic formulation in Coco v Clark, and in doing so has applied a restrictive interpretation of the exception as required by Recital 16 of Directive 2003/4/EC.
