New Front in N.Y. Nuclear Credits Battle Opens With Effort to Strike Them Down

Anew front opened in the legal battle over New York's plan to subsidize its nuclear plants with zero emissions credits with an environmental group asking a state court to strike down the credits (Hudson River Sloop Clearwater v. New York State Public Service Commission, N.Y. Sup. Ct., No. 07242-16, petition filed 11/30/16). The suit, which is the second since the credits were approved by the state Public Service Commission in August, claims that the credits violate the due process clauses in the state and U.S. constitutions and the so-called gift-and-loan clause of the state constitution.
