EPA Seeks to Resolve Coal Ash Disposal Dispute Out of Court

The EPA is working with industry representatives to rework the disputed coal ash rule outside of court, aiming for more site-specific requirements instead of an overarching framework on where coal combustion residuals end up. Federal appellate judges heard challenges Nov. 20 to a number of aspects of the Environmental Protection Agency's coal ash disposal rule (Util. Solid Waste Activities v. EPA, D.C. Cir., No. 15-1219, oral argument 11/20/17).
