The American Petroleum Institute July 7 won a partial victory in its challenge to the EPA's definition of solid waste regulations as the D.C. Circuit vacated a section related to recycling of hazardous waste materials (American Petroleum Institute v. EPA, D.C. Cir., No. 09-01038, 7/7/17). The "verified recycler exclusion," which allows generators to recycle hazardous waste materials without having a hazardous waste designation, is "unreasonable," the court said, The ruling relates to EPA's 2015 final rule governing when certain hazardous materials qualify as "discarded," subjecting them to the agency's regulatory authority.
