The U.S. Supreme Court should weigh in on how the EPA should regulate elevated pollution emissions that occur due to unavoidable equipment malfunctions at industrial facilities, according to an Ohio-based power provider (Am. Mun. Power Inc. v. EPA( U.S., 3/23/17). American Municipal Power Inc., in a petition for a writ of certiorari filed March 23, said a "significant error" by a federal appeals court places power plants and other industrial facilities at risk of enforcement actions and citizen lawsuits over unavoidable and accidental pollution releases. American Municipal Power is a nonprofit corporation that provides electric power to its members in nine states east of the Mississippi River.
