Federal appeals court will remand without vacatur maximum achievable control technology emission standards for boilers that emit large amounts of hazardous air pollutants that court previously determined were based on calculations improperly excluding certain sources because vacating standards would unnecessarily remove many limitations on emissions of hazardous air pollutants from boilers and allow greater emissions until Environmental Protection Agency completes another rulemaking and implements replacement standards.
