EPA Crafting Response To Industry, Activist Petitions On Refinery Air Rule

EPA has just launched a rulemaking to formally respond to competing industry and environmentalist petitions seeking major changes to the Bush EPA's rule amending the agency's petroleum refinery new source performance standard (NSPS), with activists pushing for stricter standards and industry arguing that the NSPS is too strict.rnAccording to the agency's March Action Initiation List of new rulemakings, EPA within 12 months will issue a notice of proposed rulemaking on the petitions to consider the petroleum refinery NSPS, which the Bush EPA amended in a June 2008 final rule. EPA received three petitions to reconsider that rule, and in September 2008 granted reconsideration and a stay of several aspects of the standard, including limits for process heaters.
