Citing Major Mercury Errors, Industry Asks EPA To Overhaul Utility MACT

The industry group Utility Air Regulatory Group (UARG) is formally asking EPA to withdraw and re-issue its proposed rule to cut mercury and other air toxics from the power sector, citing "numerous and significant errors" in the agency's analysis of mercury data underpinning the proposal that dramatically underestimates utilities' actual emissions by a factor of 1,000, leading to overly stringent toxics limits. UARG in a May 6 petition to EPA says the agency's errors warrant overhauling and re-proposing the maximum achievable control technology (MACT) air toxics proposal. UARG also suggests the errors are due to the tight timetable EPA agreed to as part of a legal settlement to issue the rule, which required the agency to propose the MACT by March 16 and issue a final version by Nov. 16.
