BALTIMORE - Chemical companies may seek legal action to block the release of confidential business information (CBI) on the combination of substances in chemical mixtures should EPA continue to release the data to activists seeking the trade secrets under the Freedom of Information Act (FOIA), industry sources say. The sources argue that litigation could be the only way to protect the information unless the agency reconsiders its policy on granting FOIA requests on chemical mixtures. "Ultimately there will be a case where it will go to court," said Christina Franz, director of regulatory & technical affairs for the American Chemistry Council, speaking at the GlobalChem Conference here March 22. "If this persists we will eventually have a case that ends in court," she said.
