Struggling to force EPA to ban lead bullets under the Toxic Substances Control Act (TSCA), environmentalists are making a novel push to ban the use the bullets at a national forest in Arizona, charging that bullets in carcasses or missed shots constitute an illegal disposal of hazardous materials under the Resource Conservation & Recovery Act (RCRA). In the suit, Center for Biological Diversity (CBD) et al, v. U.S. Forest Service, filed Sept. 5 in the U.S. District Court for the District of Arizona, environmentalists argue that the U.S. Forest Service "has contributed and is contributing to the past or present disposal of solid or hazardous waste, which may present an imminent and substantial endangerment to health or the environment by failing to use its broad authority to stop the disposal of lead in the form of spent ammunition within the Kaibab National Forest."
