EPA, Industry Say Court Lacks Power To Hear Suit Seeking Air Toxics Rules

EPA and industry groups are asking a federal district court to reject environmentalists' suit that the agency is violating a Clean Air Act mandate to issue air toxics rules covering certain pollutants, saying the court lacks power to hear the suit as it ultimately challenges the validity of existing air toxics rules and such claims must be filed in an appeals court.The Sierra Club July 5 filed a motion in the U.S. District Court for the District of Columbia asking the court to end the agency's "flagrant violation" of a two-year-old court order requiring it to meet a Clean Air Act section 112(c)(6) mandate to set strict emission standards for 90 percent of certain persistent, bioaccumulative and toxic (PBT) air pollutants. Advocates claim EPA has failed to take steps toward meeting that mandate.
