The guarantee of adolescent and children central rights to education is of extreme importance to face social exclusion and citizenship effectiveness. Social Excluded families have a greater probability of the intergenerational cycle of poverty perpetuation, where their children and adolescent do not have the guarantee of access/frequency to school. However, how is Brazil trying to guarantee adolescent and children rights to education to face social exclusion and citizenship effectiveness? This paper main objective is to analyze adolescent and children slavery, law protection to guarantee children education and public policies that make the children and adolescent right to education real. The chosen method was the documental and bibliographical analytical research. It was possible to understand that the globalized capitalist model contributes to slavery, domination and exclusions, moving children and adolescent away from education and making the critical thoughts development difficult, perpetuating the dominance model. The most important objective of the education right effective during the childhood, through the articulated public policies, is to face the obstacles to its universalization, ensuring the social inclusion and the citizenship rights, as an important tool to finish with the intergenerational cycle of poverty.
