The government has generated an array of initiatives in the run-up to the election, with several about payment. One recent consultation asked whether trade bodies would like to represent their members in situations where the contract terms might be 'grossly unfair'. The expression derives from the 2013 change to the Late Payment Act, one of several legislative and voluntary initiatives that have tried to fix payment and contractual abuse. In the consultation, the ECA was not alone in advising government that the real issue is not whether trade bodies can help their members to go to court to get paid; it is that small construction businesses simply don't want to go to court over payment issues.
