Sicherheit und Gesundheitsschutz auf Baustellen: Vertragliche Organisation und Gestaltung der Leistungspflichten von Baustellenkoordinator, Architekt und Bauunternehmer

Dem Bauherrn obliegen Leistungspflichten nach der Baustellenverordnung -BaustellV-, die häufig auf andere Projektbeteiligte übertragen werden (Baustellenkoordinator für Sicherheit und Gesundheitsschutz -SiGeKo-, Architekt, Bauunternehmer). Der vorliegende Beitrag ordnet die nach der BaustellV geforderten Planungsmaßnahmen sachlogisch den Projektphasen der Planung und Bauausführung zu. Hierzu passend erfolgt eine vertragsrechtliche Abgrenzung in Bezug auf Pflichten traditioneller Planungs- und Bauverträge. Es werden daraus Empfehlungen abgeleitet, die der Organisation und inhaltlichen Gestaltung der Verträge von Baustellenkoordinator, Architekt und Bauunternehmer dienen. Die Vorschläge sollen die Effizienz der Projektorganisation verbessern und unnütze Kosten für den Bauherrn vermeiden.%The person commissioning the building work is subject to the obligations to perform services in accordance with the Construction Site Ordinance that are frequently transferred to other parties involved in the project (construction site coordinator for environmental health and safety, architect, building contractor). The present contribution assigns the planning measures required in accordance with the Construction Site Ordinance to the project phases of planning and of carrying out the building work according to the logic of the task. A contractually legal demarcation in relation to the duties of traditional planning and building contracts suitable for this is effected. Recommendations that serve to aid the organisation and arrangement of the contents of the contracts of the construction site co-ordinator, architect and building contractor are derived from this. The suggestions should improve the efficiency of the project organisation and avoid unnecessary costs for the person commissioning the building work.
