Proposed Rule Addresses NSR Debottlenecking, Aggregation, and Project Netting

The new source review (NSR) program uses the preconstruc-tion permitting process to control the construction of new major sources (and modifications to existing sources). In attainment areas, these preconstruction permits are referred to as prevention of significant deterioration (PSD) permits, while in nonat-tainment areas they are known as nonattainment NSR, or simply NSR, preconstruction permits. Collectively, the PSD and nonattainment NSR programs are referred to as the "major" NSR program. Federal major NSR requirements are codified in 40 CFR §§51.165, 51.166, 52.21, and 52.24, and in Appendix S to Part 51.
