AIPLA did not support either party in the amicus brief it filed in the Federal Circuit's Lexmark case. Instead, AIPLA advocated for positions that would maintain the carefully established balance between government-sanctioned monopolies and the effective use of intellectual property. The Federal Circuit has already struck this balance through its precedents. The Federal Circuit rightfully stood by its decisions in Jazz Photo and Mallinckrodt, just as AIPLA had urged the Federal Circuit to do.
