In the case of Pope &Ors vR & C Commrs, the Upper Tier Tribunal (UTT) held that where the assured under a life insurance policy was missing presumed dead, a payment to his parents representing interest on the sum insured was not taxable since they were not 'entitled to the income', having only an indirect interest in the deceased's estate.
