低保退出机制中个体价值的尊重与保障

ABstract:The minimum living standard security system has multivariate function,including offer basic living security and help people to live independently. When people had the ability to live independently,he should withdraw. Administration should perform positive obligation to reexamine the qualification. These people belong to weakness group which are secured by minimum living standard security. So in withdrawal mechanism,besides the programming examine,professional social worker could intervene. They can do family budget survey,help weakness group to know complicated law and rules,and provide psychological counseling by social case work. The individual value can be respected and guaranteed from these measures.%最低生活保障制度具有多元目标，既要提供基本的生活保障，也须帮助公民独立生活。当公民具备独立生活的能力，其享有社会保障的资格需要退出。政府在这一领域履行积极义务，进行资格再审查。享受低保的个体属于弱势群体，因此除了建立完善的审查标准和程序外，退出机制中还需关注个体的价值。我国在大规模的程序化操作之外，可以由专业的社工工作人员介入，进行家计调查，运用个案方法进行情绪的辅导和梳理，帮助其了解复杂的法律制度，以维护个体在低保制度退出机制中的利益，从而实现低保制度的多元目标。
