日本现行自白任意性规则深受美国的影响,在一定程度上可以说是以美国为模板建构起来的.但与美国又存在诸多的不同,一方面自白任意性的适用基准不同,另一方面程序性保障措施有别.其缘由具有多元性,作为舶来品的自白任意性规则没有得到日本民众内心的认同,移植而来的法律制度与日本传统法律文化格格不入是根本原因.借鉴域外的经验制度固然重要,但要适当考虑本国的法律文化.只有如此才能发挥预期功能,否则容易流于形式.%The voluntary rule of confession in Japan is deeply affected by the United States, and to a certain extent, it is a model of the United States. However, there are some differences, which are as following:the determination standard of confession voluntary rule is different and procedural safeguard measures are different. The reason is multiple, of which is that the confession voluntary rule in Japan have not been recognized by Japanese people in their soul, and the legal system transplanting from U. S being out of tune with Japanese traditional legal culture is the fundamental cause. Learning from the o-verseas experience system is important, however, it should give consideration to their national legal culture. Only in this way, can it play function as ex-pected, otherwise to become a mere formality.
