国际运输业反垄断豁免制度研究--兼评彼得•卡斯坦森反垄断豁免理论

是否给予运输业的联盟反垄断豁免权，是中国当前反垄断理论的一个重要问题。美国传统的反垄断豁免理论受到强烈挑战，威斯康辛法学院教授彼得·卡斯坦森是一个典型代表。本文分析了彼得·卡斯坦森教授对于美国传统反垄断豁免理论的质疑已经其提出的替代性解决方案，即两步骤可撤销授权理论。最后，文章提炼出对于中国反垄断豁免制度的可借鉴之处。%Whether to give the antitrust exemption right to the transportation association is a very important issue in today's antitrust theory. Traditional antitrust exemption theory is challenged heavily, and Peter C. Carstensen is a representative of them. The paper gives an introduction of his theory in which he criticizes traditional antitrust exemption theory in America and presents his new solution:revocable two-step authorization theory. At last this paper proposes suggestions for today's antitrust exemption system of transportation in China according to Peter C. Carstensen’s Theory.
