论法院自由裁量权的规范--基于法律解释方法的分析

摘要

在司法实践中，法律解释学并不具有方法论的意义，人民法院对各种解释方法的选择不是智识性的，而是策略性的。尽管如此，我们不能否定法律解释方法的作用，特别是对自由裁量权的规范作用。为确保法律解释方法得到正确运用，当前各级人民法院一方面要以马克思主义法哲学作为办案指导，另一方面要拓展生效裁判文书向社会公开的广度与深度。而从长远来看，则需要改革完善法官制度，建设一支职业化与民主化相结合的高素质法官队伍。%In the judicial practice , the interpretation of the law is not methodologically meaningful , the choice of methods to interpret by the people court is not intellectual , but strategical .Even so , we still can not completely negate the method of legal interpretation , especially the regulation of discretion .In or-der to ensure the correct application of the legal interpretation methods , at present , the people courts at all levels should take Marxism philosophy of law as the guidance on one hand , and on the other hand , ex-pand the breadth and depth of judgment documents to the public .In the long run, we need to reform and improve the system of judges , and build a team of judges that combines the high -quality judges of occu-pation and democracy .
