The system of village governance is an important means to implant the will of the state into the rural society. As a representative of the dem-ocratic village governance system, "Rules and Regulations of Bazheng Village have experienced the historical evolution from the typical experience to something in suspense. This suspense is apparently a difficulty in the democratic village governance and also a lack of control by the township party committee over the village governance system. Essentially, it is a deficiency in the endogenous system of village governance. This paper holds that the formation of village order results from the top-down administrative construction and the bottom-up village endogenous order implementation, and that the pattern of township government over village governance determines the game to be reconciled. The paper, therefore, maintains that due attention should be paid to the destruction of village governance by the administrative order, and that actions should be taken to actively absorb, integrate and regulate the contradiction and conflicts between the endogenous resources of village governance and administrative resources by means of scientific de-sign and compatibility of the system.%村治制度是实现国家意志植入农村社会的一种重要手段. 作为民主村治制度的代表,"八郑规程"经历了由经验典型到无奈悬置的历史演变,"八郑规程"的无奈悬置表面上看是民主治村空心化难题、民主与效率两难兼顾、乡镇党委政府对村治制度调控缺失造成的治理困境,从本质上来讲是村治制度内生化不足的问题. 本文认为村庄秩序的形成是基于自上而下的行政构建秩序与自下而上的村庄内生秩序相互博弈的结果,乡政村治的治理格局决定了这种博弈只能是调和. 因此,文章提出应正视行政构建秩序对村治内生秩序的破坏性一面,从提高制度设计的科学性和兼容性着手,积极吸纳、整合、调和村治内生资源和行政法治资源的对立与冲突.
