章程视野下大学成员及其权利保障比较研究

         

摘要

The title of the university members reflects the identity of both teachers and students in the university ,who can obtain rights and assume specific duties granted by the university statutes .However , these rights and duties are inconsistent under China's and foreign university statutes .Based on the differ‐ence of the membership norms ,there are sharp differences in the protection of the rights of teachers and students between China and foreign universities .Drawing on the current education system reform in Chi‐na ,we can take standard mode overseas for reference ,use the standard expression of'members of the uni‐versity'in the construction of university statutes ,and provide systematic protection of due process .%大学成员的称谓体现了教师和学生在大学中的主体身份,因成员身份而获得大学章程赋予的权利并承担特定的义务,中外大学在其章程中对此规定不尽一致。基于成员身份规范的不同,在教师和学生的权利保障方面,中外差异亦较为显著。联系当前国家教育改革的实际,可借鉴域外的规范模式,在大学章程的建设中采用“大学成员”的规范表述,并提供体系化的正当程序保障。
