对我国恶意产品侵权适用惩罚性赔偿的探讨——兼析我国《侵权责任法》第四十七条之规定

摘要

我国学界对恶意产品侵权适用惩罚性赔偿素有争论。恶意产品侵权应当适用惩罚性赔偿，而且由此造成的精神损害赔偿也应计入惩罚性赔偿的范围，而恶意产品侵权惩罚性赔偿的数额则应当由法院根据具体的情况进行裁量。%　　There are some arguments about the application of punitive compensation to malicious products infringement. This article thinks that the tort of malicious product should apply to punitive damages; the spiritual damage compensation due to products tort should also be included in the scope of punitive damages; the amount of punitive compensation caused by malicious product infringing should be at the discretion of the court.
