劳动者民主参与权之权属透视

         

摘要

构建和谐劳动关系应尊重劳动者的民主权利,劳动者享有民主参与权不仅可以参与企业经营,更可以分享企业利润,应当说,劳动者经营参与和劳动者财产参与的目标都是维护劳动者的精神权益与物质利益,共同凝聚着维护劳动者体面生存、良性发展的需求和实质平等、社会正义的价值追求。目前,劳动者民主参与权在为各国立法中均被界定为一种法律权利,在司法实践中也赋予了劳动者物质与非物质利益。因而,劳动者民主参与权的确立不仅标志着人权理念的进步,更可以在实践中确保劳动者的个人权益。%To build harmonious labor relations ,we should respect the laborers'democratic right . Laborers who have the democratic participation right can not only share operational control ,but also can share surplus value , and can meet the needs of the laborers right to life and the right to development .Judged from a legislative perspective and judicial perspective , laborers'democratic participation right is defined as a legal right in each country , and it gives the laborers material and non -material interest in judicial practice .So , the establishment of laborers'democratic participation right not only symbolizes the concept of human rights progress ,but also ensures the interest of laborers .
