国外与港、澳、台地区犯罪记录规范性评价规则研究

摘要

The principle should be obeyed about how to treat the criminal record of foreign countries ,Hong Kong ,Macao and Taiwan . The recognition and evaluation of the foreign criminal records should be based on jurisdiction , reciprocity and mutual benefit principle . The criminal records of Hong Kong , Macao and Taiwan regions should recognize each other , and the special problems encountered in the course of the evaluation of the criminal record can be resolved through the principle of case consultation .%对国外犯罪记录与港、澳、台地区犯罪记录规范性评价规则应采取区别对待的原则.对外国犯罪记录应根据管辖权及对等、互惠原则进行承认与评价 ;对港、澳、台地区的犯罪记录应相互承认 ,在犯罪记录评价过程中遇到的特殊问题 ,可通过个案协商的原则进行解决.
