涉外劳动纠纷解决机制探索--以自贸区劳动关系国际化为背景

         

摘要

随着我国自贸区改革开放提速,自贸区劳动关系朝着多元化、国际化方向迈进,探索多元包容的涉外劳动纠纷解决机制成为必然的趋势。我国涉外劳动关系概念模糊不清、涉外劳动制度不完善、涉外劳动纠纷管辖不合理、法律适用的排他性以及劳动纠纷解决机制烦冗等,不利于我国涉外劳动纠纷的及时、公正解决。多元包容的涉外劳动纠纷解决机制包括:合理、包容的管辖制度、包容的法律适用机制、多元的纠纷解决机制。%With China's FTA reform and opening up,the labor relations there are moving in the direction of diversification and internationalization,and it has become an inevitable trend to explore the multi -dimension-al and inclusive resolving mechanism of foreign labor disputes.Due to ambiguity of the concept of foreign labor relations,the imperfection of foreign labor system,unreasonable jurisdiction of foreign labor disputes,the ex-clusive application of law,and complex and lengthy labor dispute resolution mechanism,all of which are not conducive to the timely and fair settlement of China's foreign labor disputes.Pluralistic and inclusive foreign labor dispute resolution mechanism includes reasonable and inclusive jurisdiction system,inclusive legal appli-cable mechanism and multiple and efficient dispute resolution mechanism.
